If for any reason whatsoever, 40 days after the date of the Notice, the Dispute has not been resolved, the Parties must either agree upon selection of a mediator or request that an appropriate mediator be appointed by the President of the Conflict Resolution Service or his or her nominee;

The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a pre-condition to the mediation commencing. The Parties must each pay their own costs associated with the mediation;

The mediation will be held in Salzburg, Austria.

Confidential
All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as "without prejudice" negotiations for the purpose of applicable laws of evidence.

Termination of Mediation:
If 3 weeks have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.
11.Venue and Jurisdiction
The Services offered by Pirita Hilton is intended to be viewed by residents of Austria. In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of Salzburg, Austria.
12.Governing Law
The Terms are governed by the laws of Salzburg, Austria. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of Salzburg, Austria, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns.
13.Independent Legal Advice
Both parties confirm and declare that the provisions of the Terms are fair and reasonable and both parties having taken the opportunity to obtain independent legal advice and declare the Terms are not against public policy on the grounds of inequality or bargaining power or general grounds of restraint of trade.
14.Severance
If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.
Waiver
During class, it is important that you listen to your body, and respect its limits on any given day. You understand that yoga includes physical movements as well as an opportunity for relaxation, stress release and relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious, disabling, or injury leading to death is always present and cannot be completely eliminated. By agreeing to this waiver, you assume full responsibility for any and all damages, including death, which may incur through participation.
You understand that Yoga is not a substitute for medical attention, examination, diagnosis or treatment and you practice at your own risk. Yoga is not safe under certain medical conditions and is not recommended. By agreeing, you affirm that a licensed medical professional or physician has verified your good health and physical condition to participate in yoga classes if required. If you are pregnant, become pregnant or are post-natal or post-surgical, your agreement verifies that you have your physician’s approval to participate.
You also agree that you alone are responsible to decide whether to practice yoga and participation is at your own risk. You agree to irrevocably release and waive any claims that you have now or may have hereafter against Pirita Hilton for any personal injury, damage, death or negligence. Additionally, Pirita Hilton is not in any way responsible for any loss or damage of your personal property.

3.2. We offer a 30-day money-back guarantee on The Cycle Conscious Collective or 1:1 coaching (including intensives, and 3-, 6- and 9-month coaching containers). If, within 30 days of enrolling, you're not seeing results and decide that it's not for you, you will need to notify Pirita Hilton in writing.
3.3. When you notify Pirita Hilton in writing, you will need to show and demonstrate what steps you have taken to get results. If you haven't got results because of lack of time, commitment, willingness to learn or because of change of mind, you're not eligible for a refund.
3.4. If you request a refund within 30 days from enrolling and can demonstrate that you have taken the steps to implement what you have learned and have sincerely worked towards getting results, you will be granted a refund.
3.5. Pirita Hilton won't be refunding any transaction fees or refund fees that are charged by a third-party payment provider (Stripe or PayPal).
3.6. Refund requests that are submitted after 30 days of enrolling won't be considered.
Products Damaged During Delivery
4.1. In the event that the product you ordered has been damaged during delivery:

(a) Please contact us as soon as possible.

(b) Any damaged product must be returned in the condition in which it was received, together with any packaging and other items which you received with the damaged product.
4.2. We will arrange to repair or collect the damaged product and replace it with an equivalent product, or to refund it, provided that you have contacted us within the following time from the date of receipt of the product: seven (7) days.
Exceptions
5.1. Notwithstanding the other provisions of this Policy, we may refuse to provide a repair, replacement or refund for a product or service purchased by you if:

You misused the said product in a way which caused the problem.

You knew or were made aware of the problem(s) with the product or service before you purchased it.

You asked for a service to be done in a certain manner, or you asked for alterations to a product, against our advice, or you were unclear about what you wanted.

Any other exceptions apply under the European Union Consumer Law.
Response Time
6.1. We aim to process any requests for repairs, replacements or refunds within fourteen (14) days of receipt.

7.1. You can contact us at the end of this Policy to discuss a return using the information.
7.2. Unless otherwise defined in our sole discretion, we shall pay all refunds in the same form as the original purchase or to the same account or credit card used to make the original purchase.
7.3. To be eligible for a refund, repair or replacement, you must provide proof of purchase.
7.4. You may be required to provide government-issued identification to qualify for a refund, repair or replacement.
